Stamp Duty Land Tax (SDLT) consultation

HMRC have published a consultation entitled 'Stamp Duty Land Tax: Mixed Property Purchases and Multiple Dwellings Relief' looking at changing the taxing provisions to:

  • Adjust the SDLT calculations for purchases that consist of both residential and non-residential property.
  • Review the appropriateness of Multiple Dwellings Relief.

Stamp Duty Land Tax and Freeports

Purchases of land and buildings where a site has been designated a Freeport will receive SDLT relief provided the effective date of the transaction is between designation and before 30 September 2026.

The latest freeport sites are:

  • Humber, Thames, Teesside which took effect on 19 November 2021.
  • Freeport East became a freeport on 30 December 2021.

Stamp Duty Land Tax temporary rates

From 1 October 2021, the SDLT tax bands reverted to their pre-8 July 2020 levels.

The nil rate band for residential purchases has now returned to £125,000.

Securitisation and insurance-linked securities

Following an earlier consultation, HMRC have published statutory instruments for technical consultation which aim to provide exemptions from Stamp Duty and Stamp Duty Reserve Tax for securitisations and for insurance-linked securities.

New regime for the taxation of qualifying asset holding companies

Stamp Duty and Stamp Duty Reserve Tax relief are to be introduced for repurchases of share and loan capital previously issued by qualifying asset holding companies.

Ipsos MORI voluntary research

An independent research agency has been appointed to help HMRC understand investment behaviour and the factors which influence those decisions.

HMRC are looking for volunteers to take part in this research.
