In recent years we have witnessed HMRC’s increased use of one-to-many ‘nudge’ letters; an informal approach to encourage wider tax compliance. Using this method, HMRC have now started targeting individuals they believe have income to declare from online marketplace sales, up to 5 April 2023.

This has been something of a hot topic over the last year. Much misinformation has been shared online suggesting that a new ‘side-hustle tax’ had been introduced, following the commencement of reporting obligations for digital platform operators. The first reports by platform operators, for the 2024 calendar year, were due to be made to HMRC by 31 January 2025.

As a result, it seems likely that we will see increased tax compliance activity in this area over the coming months, as sellers' data continues to be analysed. From the perspective of any potentially affected taxpayers, it will be imperative to assess the precise facts and circumstances of selling activities, to determine whether they are trading or not.

In other news, we feature one tribunal decision this week. The Upper Tribunal (UT) considered an Inheritance Tax (IHT) ‘home loan scheme’ which was designed to remove the value of an individual's home from their IHT estate while allowing them to continue residing in it.

The First Tier Tribunal (FTT) had previously found that the arrangement was ineffective, but the UT disagreed. This decision makes for interesting reading in the context of tax planning and the related anti-avoidance provisions.

HMRC have published new advisory fuel rates for company car drivers from 1 March 2025.

HMRC target online sellers
In their latest one-to-many letter campaign, HMRC are targeting individuals believed to be operating in the hidden economy by selling via online marketplaces, and not declaring their income.

Home loan scheme was effective for IHT
In The Executors of Mrs Leslie Vivienne Elborne Deceased & Ors v HMRC [2025] UKUT 00059 (TCC), the Upper Tribunal (UT) found that an Inheritance Tax (IHT) home loan scheme was valid. The value of a settled property within a deceased's estate could be reduced for IHT purposes by an associated loan note as it was not a 'debt incurred by' the deceased under anti-avoidance legislation.
